DUI Cases

Drivers who are suspected of being under the influence of alcohol or drugs will be arrested. They will be asked to take a breath analysis or blood-alcohol test.

A person can refuse. On the other hand, the field sobriety tests are voluntary. There is no adverse consequence that directly stems from refusing to take the tests, but a refusal may be used against a person in a subsequent trial for DUI.

HOA

At The Rouse Firm, we represent Homeowner's Associations(HOA) in the Atlanta area in HOA-related disputes. Disputes and HOA-related litigation usually arise when homeowners are accused of violating the Association's governing documents, primarily the CC&R1s. Such disputes often center on alleged failures to pay assessments due, obtain approval for architectural changes, pay fines or comply with other rules and regulations.

Although Associations are empowered to enforce the legally-enacted rules, the enforcement must be reasonable and many Associations and their boards overreach and abuse their powers. An experienced HOA attorney can help you defend your position and negotiate a reasonable outcome to your HOA dispute.

Traffic

A traffic ticket is technically known as a citation. A citation is a court document issued by an officer of a city, county or state for failing to obey the traffic laws of that particular jurisdiction. The citation needs to contain your name, driver’s license number, the offense you are charged with, your court date, the officer’s name, the jurisdiction and location of the court.

If you receive a ticket, you will generally have to pay a fine. Each state has a schedule of fines and penalties depending on the offense. The fines may be increased depending on the class of your license and/or the zone in which you received the citation. For example, if you are caught speeding in a school or work zone you can expect that your fines will be considerably more.

If you disagree with the charge You have options to avoid pleading guilty to the charge.

  • Let us negotiate a plea arrangement for a lesser offense before the fines are due and paid.
  • Attend traffic court and see whether you can negotiate a lower plea or, in some limited circumstances, have the charge dismissed before you pay the fines. The district attorney, judge or magistrate may require you to return at a later date to either produce documentation and/or complete a driver’s education course

Wills & Probate

Some estate plans may be complicated while others are more straightforward. Whatever depth of detail your plan requires, take time to determine what matters to you. Once you’ve considered your priorities and what you want to have happen, you may want to consider putting certain legal documents into place to ensure your plan is carried out.

Many people assume that if they don’t create an estate plan, the laws of their state will appropriately distribute their property to family members. While this is true in many cases, you may give up certain rights if you don’t know your options. For instance, an estate plan may help you:

  • Ensure your intentions are met.
  • Prevent disputes and ease decision making for family members.
  • Reduce stress for your family at a difficult time.
  • Minimize or eliminate estate taxes.
